This agreement applies to any work submitted between May 13th 2012 and August 31st 2012, and continues in perpetuity from the time a work is submitted until, if accepted, the publication it’s a part of goes out of print.
By submitting work to ZenFri Inc. you (hencefourth referred to as the Submitter) agree to allow ZenFri one-time, non-exclusive publishing rights. The publication which your work appears in can be distributed for profit in both digital and print formats indefinitely, or until ZenFri removes the publication from printing.
For the purposes of this agreement, a publication consists of any published material or document which across formats and venues maintains identical works, from an identical list of contributors, presented in the same order and which has at most two ISBN numbers (one for digital publication, and one for print).
The Submitter guarantees that they are either a) the creator of the piece being submitted or b) have been granted the necessary rights to distribute and profit from the submitted work(s).
ZenFri will always let the submitter know the status of their work, as soon as a decision on its status has been made. Up until that time, the submitter cannot withdrawal their work from consideration. Generally this process will take between three and fives months. We encourage submitters to check up on their status at anytime.
Once a piece has been accepted for publication, ZenFri is able to publish the work in its submitted form, upon written acknowledgement from ZenFri to the submitter that their work has been accepted. At ZenFri’s discretion, edits maybe made to the submitted piece to prepare it for publication. However, the submitter will always have final say on whether or not to accept or reject any changes to their work.
Compensation
In exchange for rights to publish the Submitter’s work, ZenFri agrees to compensate the Submitter with an equal share of the revenue generated from the publication as every other Contributor whose work is contained within a given publication. No Submitter or Contributor shall receive revenue from issues, editions or versions of a publication in which their work doesn’t appear.
What we define as a Contributor
A contributor is any individual or group who contributes a work which is published by ZenFri. If, for example, a short story piece has two authors, they are compensated as a single contributor. Similarly, if ZenFri requires multiple parties to manage the publication, distribution and marketing of a publication all those individuals count as one contributor – The Publisher.
Below is a list of contributors:
- The Publisher (ZenFri) counts as a single contributor.
- The Editor(s) of the overall publication counts as a single contributor.
- The Creator(s) of a single piece of content count as a single contributor. This could be a single piece of visual art, or fiction.
- If an employee or owner of ZenFri Inc. contributes a piece of content such as a work of fiction or visual art, that is outside of normal publishing duties this shall counts as a contribution separate from that of ‘Publisher’, and be equal to that of a Creator.
No contributor is allowed more than a single piece of content per publication.
Payment
Upon publication, all Contributors beyond ZenFri will be paid their share of revenue in CND or US Dollars, by check. This check will be mailed out to eligible Contributors within three weeks of ZenFri receiving payment from a vendor, so long as the value payable is more than the cost of mailing the check.
If the Submitter’s work is pulled from a publication at anytime prior to it’s public release or first sale, ZenFri is under no obligation to compensate the Submitter.
The cost of mailing the Submitter’s check will be subtracted from their share of the revenue. Since ZenFri Inc. is based in Canada, works from within Canada will have lower mailing costs.
Communication with a Contributor
ZenFri will notify the Submitter if their work has been accepted or rejected via e-mail. If the submitter receives no formal acknowledgment concerning the status of a piece after 5 months, the submitters is encouraged to contact ZenFri and inquire.
NOTE: Only changes permitted by the Submitter beyond corrections to spelling and grammar will go to print. Failure by the Submitter to respond to requested changes within a reasonable time (two weeks) may result in the work being pulled from publication, or being published in the state it was originally submitted.
Disclosure of Sales Information
ZenFri will openly provide information regarding the sales of any issue which includes the Submitter’s work, at least once a month and upon request, until the publication is no longer in print. Disclosure of sales information by the Submitter to any third party beyond that which is required by law is prohibited.
